Best Practices for Sellers

Are you overwhelmed by your seller’s disclosers and unsure of how to fill them out? It is vital to ensure you are safe during and after the sale of your home so it is always best to over-disclose rather than under-disclose and I am here to explain why. I have been in business for over 15 years and I’ve never had a lawsuit nor have any of the sellers or buyers and that’s because I am sure to stay up to date on laws and regulations regarding disclosures.

When listing your home, disclosing everything that has been repaired, replaced, modified, or added, is imperative and will help keep you out of the courtroom. It is essential to complete the seller’s disclosures prior to listing your home. We want to make sure that buyers have ample time to review before placing an offer. The more information they have about the home the better, it will make their offer stronger and leave no elements of surprise and when you disclose properly you don’t have to worry about them coming back to you later and telling you that they want to go to court or they want to extract more money out of you. Obviously, you do not know what you do not know, and you can only disclose what you know about.

Seller’s Disclosures are a safety net not only for the buyer but for you as the seller as well. One of the biggest reasons for lawsuits for sellers is the failure to disclose and this is especially an issue for For Sale By Owners. Disclosing things like if there has ever been water in the basement, or any roof leakage, even if it has been repaired is so important to disclose. It is also important that if you have had any insurance claims that have been filed in the past on the home need to be disclosed as well.

To disclose or not to disclose that is a question I get all the time and my answer is always is if you have to ask if you should disclose the answer is YES! Over disclosure is always better than under disclosure.
